Srinagar, July 24: When a Bollywood film shows a ghost helping police unveil a mystery or informing the court about vital clues to ensure effective administration of justice, most of the viewers reject it as a figment of imagination. But in undivided Kashmir this happened in real life. The incident has been reported by a renowned lawyer Bal Kak Dhar (Balji) in his famous book My Experiences at Bar that he wrote in memory of his daughter who died at a young age.
A murder case was committed to the court at Muzaffarabad (now the capital of Pakistan-administered Kashmir). The accused was the husband of the deceased. When the case came up for hearing, a visibly shaken husband pleaded that he was not present at the scene when his beloved wife was butchered. After several hearings he proved it beyond any reasonable doubt. The learned judge, Abdus Samad, being a God-fearing person accepted his contention and accordingly absolved him of the charge.
The police then arrested the deceased?s father for the murder. A challan was filed against him in the court. The Judge was convinced of his involvement in the murder but the accused pleaded not guilty. The learned judge told the lawyer (Balji) to enquire from his client. The lawyer in his capacity as an officer of the court promised the presiding officer of his full cooperation. Balji talked to the accused in private but he pleaded innocence.
The trial progressed and notwithstanding the belief of the learned judge, he could not find material evidence to punish the accused. But, before the accused could be acquitted of the charge of murder, the court received help from unexpected quarters. What is being shown in reel life happened in real life that day.
The deceased?s ghost came to help the court in typical Bollywood style, informing the court that she was deeply in love with her husband who also loved her very much. Ruling out her husband?s involvement in her murder, the ghost told the learned judge that her father murdered her for her property and dower amount. The ghost also told the judge to visit a particular spot in district Varmul to find the much-needed evidence against the accused.
Next morning the learned judge informed his staff, accused and the defence lawyer to get ready for a journey to Varmul. They reached Khawaja Bagh and entered the house of the accused. The deceased had visited her father?s house after long time only to get murdered by him. The visiting team found the deceased?s skeleton and other crucial evidence.
The evidence collected at the accused?s house was sent for analysis to Floor (Punjab). The report confirmed the involvement in murder of the accused, who was accordingly punished.
